Terms and Conditions of the Imifanekiso Modeling Campaign
1. **Eligibility:** Applicants must be of legal age as per local laws or have consent from a parent or guardian if underage. Models must be able to travel to our Durban branch for photoshoots.
2. **Application and Acceptance:** Submission of an application does not guarantee acceptance. Successful applicants will be notified via SMS or call. The decision of Imifanekiso Online regarding model selection is final.
3. **Joining Fee and Payments:** A non-refundable joining fee of R500 is required upon successful application. This fee covers the initial photoshoot and portfolio setup. No further charges for monthly photoshoots, provided the model adheres to the agreed schedule.
4. **Photoshoots and Portfolio Updates:** Models are required to attend monthly photoshoots to update their portfolios. Failure to attend scheduled photoshoots without prior notice may result in termination of the agreement.
5. **Use of Images and Intellectual Property:** Imifanekiso Online retains ownership of all photographs taken. Models are granted limited rights to use these images for their personal portfolios. Commercial use of these images by models is strictly prohibited without prior written consent from Imifanekiso Online.
6. **Promotion and Representation:** Models are expected to promote Imifanekiso Online's photography packages positively. Any misrepresentation or conduct deemed harmful to the brand may result in termination of the agreement.
7. **Biography and Information Submission:** Models are responsible for providing accurate and appropriate biographical information. Imifanekiso Online reserves the right to edit or refuse to publish any content deemed inappropriate.
8. **Termination of Agreement:** Either party may terminate this agreement with written notice. Imifanekiso Online reserves the right to terminate the agreement immediately in cases of breach of terms, misconduct, or misrepresentation by the model.
9. **Liability and Indemnification:** Models participate in photoshoots at their own risk. Imifanekiso Online is not liable for any injury or loss incurred during the participation in the campaign. Models agree to indemnify Imifanekiso Online against any claims arising from their actions.
10. **Governing Law:** These terms and conditions are governed by the laws of the country/state where Imifanekiso Online is based. Any disputes will be subject to the jurisdiction of local courts.
11. **Amendments:** Imifanekiso Online reserves the right to amend these terms and conditions at any time.
12. **Acceptance of Terms:** By applying for the Imifanekiso Modeling Campaign, the model acknowledges and agrees to these terms and conditions.
